I bet that's a question you never thought you'd hear! Should you re -marry your ex wife or husband to save on death duties?
“A very thought provoking piece showing the complexities of the Inheritance Tax Laws and why you need a good balance of legal and practical advice from an expert legal practitioner when trying to engage in estate planning to mitigate Inheritance Tax”
On an estate worth £3m the inheritance tax due would be roughly £1.1m if that estate were wholly owned by a single person. It would be £940,000 if owned jointly by a married couple. So it is easy to see why the question of re-marrying might arise where the aim is to reduce the tax bill as far as possible. However, if the £3m is split between you and your ex-wife, the advantage of re-marrying is less clear. The only way in which remarrying your ex-wife could help regarding inheritance tax would be if you wished to delay the payment of the tax. Even then there is not a definite advantage. Regardless of whether you remarry or not, you will still need to pay inheritance tax.
